Terms of use
These terms cover the use of the Gradlog app and the subscription you buy in the App Store or on Google Play.
1 Who we are
Gradlog is provided by Falka Software (Merlijn de Groot), Box C8803, Zinkstraat 24, 4823 AD Breda, registered with the Dutch Chamber of Commerce under number 42175658, VAT number NL005558095B21.
You can reach us at info@falka.nl.
2 What Gradlog is, and what it is not
Gradlog is a logbook for your own food-safety controls. You record temperatures, cleaning, goods receipt, cooling curves and the other records your hygiene code asks for, and you produce a dossier you can hand to an inspector.
Gradlog is not advice and not a guarantee. Regulation (EC) No 852/2004 places responsibility for the food-safety system with you as the food business operator. We do not check whether your records are correct, whether you complete them in time, or whether you are using the hygiene code that fits your business. A dossier from Gradlog shows what you recorded, and nothing more.
Every dossier carries the moment it was produced and a SHA-256 hash of its own content, which makes a later change visible. It is expressly not a qualified electronic signature within the meaning of the eIDAS Regulation.
The app interface is in Dutch. The records follow the Dutch hygiene code for hospitality (KHN, 2016).
3 Business use
Gradlog is sold to food businesses and is intended for use in the course of a trade or profession. There is therefore no consumer right of withdrawal (no fourteen-day cooling-off period) on the subscription. If you do buy as a consumer, the terms of the store you bought in apply to that purchase; that store is your counterparty for the payment.
4 Your account and user roles
- The owner signs in with an email address and a six-digit code we send by email. There is no password.
- Staff join with the eight-character location code, then pick a name and set a four-digit PIN. They need no email address.
- The roles are owner (subscription, staff, settings, dossier), manager (staff, settings, dossier) and staff member (recording and viewing the day).
- Every record carries the name of the person who recorded it, and the time.
You decide who receives the location code, and you are responsible for that choice. You can replace the code with a new one in the app. From then on, only the new code can be used to join. Phones and tablets that have already joined keep working.
5 Price and trial
A subscription covers one location. Staff log alongside you at no cost, however many there are. There are tiers for 1, 2, 3, 5 and 10 locations, monthly or yearly.
The list price is €14.99 per location per month or €149 per location per year. At checkout the store shows the price that is actually charged, including VAT and in your own currency; that price prevails over the amount on this page.
A new subscription starts with a free trial of seven days, unless the store shows something else for the plan you pick. If you do not cancel before the trial ends, the subscription becomes a paid one.
The subscription renews automatically at the end of every period until you cancel. The store charges within twenty-four hours before the new period starts.
6 Changing or cancelling your subscription
You buy your subscription from Apple or Google. As the seller, that company accounts for the VAT and handles refund requests.
You can upgrade to a tier with more locations in the app and pay through the App Store or Google Play.
You cancel your subscription in the App Store or Google Play:
- App Store: apps.apple.com/
account/ subscriptions - Google Play: play.google.com/
store/ account/ subscriptions
In your App Store subscription settings, you can also downgrade to a tier with fewer locations. The downgrade takes effect at the next renewal. On Google Play, you cancel the subscription instead and, once it has ended, subscribe to a lower tier in the app.
We cannot reverse a payment and we cannot cancel a subscription for you.
7 What happens when a subscription lapses
Once the store tells us the subscription has expired, the location keeps working in full for another fourteen days: you can go on recording everything during those days. After that the location becomes read-only. Existing records and dossiers stay visible and downloadable, new records are no longer possible. Nothing is deleted while the retention period runs. Renew, and you can record again straight away.
8 Retention
Every hygiene code sets its own minimum for how long records must be kept. For the Dutch hygiene code for hospitality (KHN, 2016) that is six months. Gradlog keeps twenty-four months by default. You can raise the period per location; you cannot set it below the minimum of the hygiene code.
9 Export and deleting your account
You can export everything you recorded at any time: one ZIP file with a CSV per record type, every dossier and every photo. The download link arrives by email and stays valid for fourteen days.
You delete the account in the app, under Instellingen → Account → Account verwijderen (Settings → Account → Delete account). If you want to keep your data, export it before you request deletion. After the request there is a waiting period of fourteen days. A download link you have already received keeps working until fourteen days after you requested the export. Signing in again as the owner during the waiting period cancels the request, even if you only sign in to make a new export. Once the waiting period is over, we permanently delete the organisation, the locations, the staff details, all records, the photos and the dossiers. After that, the data cannot be recovered.
Deleting your account does not cancel your subscription. You do that in the store, as set out in clause 6.
10 Availability and changes
Gradlog works offline: recording needs no connection, and the app sends the records on as soon as there is one again. We give no availability guarantee for the server.
We may change the app and these terms. A change that materially worsens your position is announced at least thirty days in advance to the owner email address, and you may then cancel with effect from the end of the current period.
11 Liability
We are not liable for consequential loss, lost profit, a fine or measure imposed by a regulator, or the loss of data you did not export yourself. Our liability is limited, per event and per calendar year, to the amount you paid for Gradlog in the twelve months before the event.
These limits do not apply in the case of intent or deliberate recklessness on our part.
12 Personal data
How we handle personal data is set out in the privacy statement. The data processing agreement annexed there forms part of these terms.
13 Governing law
These terms are governed by Dutch law. Disputes are submitted to the competent court in the district where we are established, unless a mandatory rule of law designates another court.
